  6. Rrankk.com's rights to the content</p>By submitting your content to Rrankk.com, you agree to the following:

<li> Rrankk.com disclaims any obligation to legally protect your works or your copyrights, and you acknowledge that we will have no liability, vicarious, contributory, or otherwise, for any infringement of any of your intellectual property rights.</p>

We have done, and still do, our utmost to construct the system to eliminate any kind of cheating and manipulation.</p>Any misconduct by you, including attempts to manipulate the rating of Rrankk.com content items will result in your immediate exclusion from Rrankk.com, at Rrankk.com's sole discretion. Any attempt by you to generate higher traffic to your polls by using automated means such as "pay to surf" web sites, robots, spiders, auto-spawning of browsers, automatic redirecting of visitors, blind text links, misleading links, forced clicks etc. will also result in your immediate exclusion from Rrankk.com.

  8. How is it in your country?

    Different countries have different regulations. Rrankk.com makes no representations that the materials on this site are appropriate or legally available for use in locations outside the United States. If you are accessing this site from jurisdictions where the contents of this site may be illegal, you are solely responsible for complying with all local laws regarding online conduct and acceptable content.

  9. We control the content and functionality:

Termination: </p>Rrankk.com has the right to terminate your account (or any part thereof), or to terminate your use of the Rrankk.com site, at any time in our sole discretion, with or without cause and with or without prior notice. In case of termination, any rights you may have to non-paid or future revenue streams will also be terminated.</p>If we decide to terminate your account, the termination will not affect your remaining responsibilities to Rrankk.com according to this User Agreement.</p>If we revoke your account, you may not open a new one.

  12. Proprietary rights:

<p>You acknowledge and agree that the contents and materials available on the Rrankk.com site and the software used in connection with Rrankk.com contain proprietary and confidential information that is protected by applicable intellectual property and other laws. Unless expressly authorized by Rrankk.com, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Rrankk.com site's contents, materials or the software, in whole or in part.</p>Except as expressly provided in this Agreement, you are not granted any rights or license to any intellectual property with respect to the Rrankk.com site or its contents. Rrankk.com reserves all rights not expressly granted to you under the terms of this Agreement and Rrankk.com retains exclusive ownership of the Rrankk.com site, the software used in connection with Rrankk.com and all intellectual property associated therewith.

<p>RRANKK.COM AND ITS AFFILIATES MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, LACK OF VIRUSES OR OTHER HARMFUL COMPONENTS AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED WITHTHIN THE RRANKK.COM SITE AND SERVICES FOR ANY PURPOSE. ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. RRANKK.COM AND ITS AFFILIATES HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS INCLUDING ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, WORKMANLIKE EFFORT, TITLE AND NON-INFRINGEMENT.

  14. Indemnity:

<p>You agree to indemnify and hold Rrankk.com, and its subsidiaries, affiliates, officers, agents, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of (a) materials that you submit, post, or upload to the Rrankk.com site, (b) your use of the Rrankk.com site, (c) your connection to the Rrankk.com site, (d) any violation of this User Agreement, or (d) your violation of any rights of another party.

Limitation of liability: </p>YOU EXPRESSLY UNDERSTAND AND AGREE THAT RRANKK.COM AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, AND INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE RRANKK.COM OR ANY MATERIALS THAT HAVE BEEN POSTED TO RRANKK.COM, ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL, UNAUTHORIZED ACCESS TO OR USE OF YOUR TRANSMISSIONS OR CONTENT, OR STATEMENTS OR CONDUCT OF ANY THIRD PARTY, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF RRANKK.COM OR ANY OF ITS AFFILIATES HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE RRANKK.COM SITE OR SERVICES, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE RRANKK.COM SITE AND SERVICES..

  YOU SPECIFICALLY AGREE THAT RRANKK.COM SHALL NOT BE RESPONSIBLE FOR UNAUTHORIZED ACCESS TO OR ALTERNATION OF YOUR TRANSMISSIONS OR DATA, ANY MATERIAL OR DATA SENT OR RECEIVED OR NOT SENT OR RECEIVED, OR ANY TRANSACTIONS ENTERED INTO THROUGH A RRANKK.COM SITE OR SERVICE. YOU SPECIFICALLY AGREE THAT RRANKK.COM IS NOT RESPONSIBLE OR LIABLE FOR ANY THREATENING, DEFAMATORY, OBSCENE, OFFENSIVE OR ILLEGAL CONTENT OR DONCUT OF ANY OTHER PARTY OR ANY INFRINGEMENT OF ANOTHER'S RIGHTS, INCLUDING INTELLECTUAL PROPERTY RIGHTS. YOU SPECIFICALLY AGREE THAT RRANKK.COM IS NOT RESPONSIBLE FOR ANY CONTENT SENT USING AND/OR INCLUDED IN A RRANKK.COM SITE OR SERVICE BY ANY THIRD PARTY.

<p>The name "Rrankk" and its respective logos, are Rrankk.com trademarks. You are not allowed to use or display any of these unless you have our prior express written permission.

  17. The entire agreement:

<p>These terms, constitute the entire agreement between you and Rrankk.com and govern your use of the Rrankk.com site ands supersede all prior or contemporaneous communications and proposals whether electronic, oral or written, between you and Rrankk.com with respect to the Rrankk.com site and services.

  18. What if we disagree?

  This Agreement shall be governed by and construed in accordance with the laws of the state of Massachusetts without application of its principles of conflicts of laws. By accepting this Agreement you expressly agree that the exclusive jurisdiction for any claim or controversy arising out of or relation to this Agreement or your use of the Rrankk.com site and services shall be only in the sate or federal courts located in the state of Massachusetts and you further agree and submit to the exercise of personal jurisdiction of these courts for the purpose of litigating any such claim or action.</p>ALSO BY ACCEPTING THESE TERMS, YOU WAIVE YOUR RIGHT TO A TRIAL BY JURY AND YOU EXPLICITLY WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT.</p>YOU AGREE THAT REGARDLESS OF ANY STATUTE OR LAW TO THE CONTRARY, ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO USE OF RRANKK.COM OR THIS AGREEMENT MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE OR BE FOREVER BARRED.

  19. Each provision is separate:

<p>The failure of Rrankk.com to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid or unenforceable, the parties nevertheless agree that the court should endeavor to give effect to the parties' original intentions as reflected in the provision, and the other provisions of this Agreement shall remain in full force and effect.
